• Export reports and analytics

3. Account Registration

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

4. Subscription and Payment

4.2 Billing

Subscriptions are billed in advance on a monthly or annual basis. You authorize us to charge your payment method for all fees associated with your subscription.

4.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, you will retain access to the Service until the end of your current billing period. No refunds will be provided for partial periods.

5. Acceptable Use

You agree not to use the Service to:

• Upload content that you do not have the right to use
• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Upload malicious code or attempt to compromise the Service
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any illegal or unauthorized purpose
• Record calls without proper consent from all parties (where required by law)

6. Your Content

6.1 Ownership

You retain ownership of all content you upload to the Service, including call recordings and related data ("Your Content").

6.2 License Grant

By uploading Your Content, you grant Total View AI a limited, non-exclusive license to process, analyze, and store Your Content solely for the purpose of providing the Service to you.

6.3 Responsibility

You are solely responsible for Your Content and ensuring you have all necessary rights and consents to upload and process such content through the Service.

7. Intellectual Property

The Service and its original content (excluding Your Content), features, and functionality are owned by Total View AI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code of that software.

8. AI and Automated Processing

You acknowledge and agree that:

• The Service uses AI and machine learning to analyze call recordings
• AI-generated results (transcriptions, scores, insights) are provided "as is" and may contain errors
• AI analysis should be used as a tool to assist human decision-making, not replace it
• We do not guarantee the accuracy, completeness, or reliability of AI-generated content
• You are responsible for reviewing and verifying AI-generated results before taking action

9. Call Recording Compliance

You are responsible for ensuring compliance with all applicable laws regarding call recording, including but not limited to:

• Obtaining proper consent from all parties to a call (where required)
• Complying with federal, state, and local wiretapping and eavesdropping laws
• Following industry-specific regulations (e.g., HIPAA, PCI-DSS)
• Providing appropriate disclosures to callers

Total View AI is not responsible for your compliance with call recording laws.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Total View AI does not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TOTAL VIEW AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Total View AI and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
